1. Purpose and agreement

These terms govern your use of SetMood (the "App"), operated by HO HWANG (the "Operator"). By using the App you accept them. Section 5 to 8 apply when you publish a filter, and you are asked to accept them before your first publication.

2. Definitions

"Filter" means a set of 14 numeric color and light values with a short name. "Public Filter" means a Filter a user has published. "Creator" means a user who publishes. "Remix" means a Public Filter made by changing another Public Filter.

3. The service

The App lets you view Filters on your own photo, shoot and save photos with them, make your own, and publish them. It needs no account and is free of charge in this version. You must be at least 14 years old to publish, or have your legal guardian's consent. Features may change, and the service may be suspended or ended; where we can, we give notice in the App or at this address. Filters on your device keep working, and you can keep them as codes.

4. Your conduct

You agree not to: break the law or infringe another person's rights; use names that are offensive, impersonate someone, or contain other companies' or products' names, contact details or links; interfere with the service, overload it, or get around its limits; or collect other users' information.

5. Publishing rules

Publish only Filters you made or are entitled to share. Up to 5 Filters a day can be published. Filters nearly identical to an existing one, and names that break these rules, are refused. Only the values, the filter name, your creator name and the original filter are published. Photos are never uploaded.

6. Rights in Public Filters

You keep whatever rights you have in your Filters. By publishing, you grant the Operator a worldwide, royalty-free licence to store, display and distribute the Filter, its name and your creator name in the App for operating the service, and you grant other users a free licence to save, use and Remix it in the App and to keep and share photos made with it. A Remix shows you as the original creator.

7. Taking a filter down

You can unpublish a Filter at any time, or delete all your public information in Settings. Copies other users have already saved stay on their devices, the licence for those copies continues, and Remixes show "Removed filter".

8. Reports, moderation and rights complaints

Anyone can report a Public Filter or block a Creator in the App. Reports are reviewed within 24 hours. A Filter reported from three different devices is hidden automatically until reviewed. The Operator may hide or remove Filters and stop a Creator from publishing if these terms or the law are broken. If you believe a Filter infringes your rights, or want to contest a decision, write to orangesea2022@gmail.com with the filter's name, the creator's name and your reason.

9. No payment

This version has no sales, payments or revenue sharing. Use counts are for display only and create no right to payment.

10. Disclaimer and liability

The App is provided as it is. To the extent the law allows, the Operator is not liable for loss arising from causes beyond its reasonable control, from Public Filters published by users, or from the loss of data kept only on your device. Nothing in these terms excludes liability for intent or gross negligence, or any right you have under consumer law that cannot be waived.

11. Changes to these terms

Changes are posted at this address at least 7 days before they take effect, or 30 days if they are unfavourable to you. If a change affects publishing, we ask you to agree again before you next publish.

12. Governing law and disputes

These terms are governed by the laws of the Republic of Korea. Disputes go to the competent court under the Civil Procedure Act. Consumers keep the protections of the mandatory law of the country where they live.

제1조 (목적과 동의)

이 약관은 HO HWANG(이하 "운영자")이 운영하는 셋무드(이하 "앱")의 이용 조건을 정합니다. 앱을 이용하면 이 약관에 동의한 것으로 봅니다. 제5조부터 제8조는 필터를 공개할 때 적용되며, 처음 공개하기 전에 동의를 받습니다.

제2조 (정의)

"필터"는 색과 빛을 나타내는 숫자 값 14개와 짧은 이름의 묶음입니다. "공개 필터"는 이용자가 공개한 필터입니다. "창작자"는 필터를 공개한 이용자입니다. "리믹스"는 공개 필터를 고쳐 만든 공개 필터입니다.

제3조 (서비스)

앱은 필터를 내 사진에 입혀 보고, 필터를 켠 채 찍고 저장하고, 직접 만들고 공개하는 기능을 제공합니다. 계정이 필요 없고 이 버전은 무료입니다. 공개하려면 만 14세 이상이거나 법정대리인의 동의가 있어야 합니다. 기능은 바뀔 수 있고 서비스는 중단되거나 종료될 수 있으며, 가능한 경우 앱이나 이 주소에서 미리 알립니다. 기기에 있는 필터는 계속 쓸 수 있고 코드로 보관할 수 있습니다.

제4조 (이용자의 의무)

법령을 어기거나 타인의 권리를 침해하는 행위, 욕설·사칭이 담기거나 다른 회사·제품 이름, 연락처, 링크가 포함된 이름의 사용, 서비스를 방해하거나 과부하를 주거나 제한을 우회하는 행위, 다른 이용자의 정보를 수집하는 행위를 해서는 안 됩니다.

제5조 (공개 규칙)

직접 만들었거나 공유할 권리가 있는 필터만 공개합니다. 하루에 5개까지 공개할 수 있습니다. 이미 있는 필터와 거의 같은 필터와 규칙에 어긋나는 이름은 거부됩니다. 공개되는 것은 값, 필터 이름, 창작자 이름, 원본 필터뿐이며 사진은 올라가지 않습니다.

제6조 (공개 필터의 권리)

필터에 대한 권리는 창작자에게 그대로 있습니다. 공개하면 창작자는 서비스 운영을 위해 앱에서 필터와 그 이름, 창작자 이름을 저장, 표시, 배포할 수 있는 전 세계적·무상 이용권을 운영자에게 부여하고, 다른 이용자에게는 앱 안에서 그 필터를 담아 쓰고 리믹스하며 그 필터로 만든 사진을 보관하고 공유할 수 있는 무상 이용권을 부여합니다. 리믹스에는 원작자로 창작자의 이름이 표시됩니다.

제7조 (공개 내리기)

언제든 공개를 내리거나 설정에서 내 공개 정보를 전부 지울 수 있습니다. 다른 이용자가 이미 담은 사본은 그 기기에 남고 그 사본에 대한 이용권은 유지되며, 리믹스에는 "내려간 필터"로 표시됩니다.

제8조 (신고, 검수, 권리 침해 신고)

누구나 앱에서 공개 필터를 신고하거나 창작자를 차단할 수 있습니다. 신고는 24시간 안에 검토합니다. 서로 다른 세 기기에서 신고된 필터는 검토할 때까지 자동으로 숨겨집니다. 운영자는 약관이나 법령을 어긴 필터를 숨기거나 삭제하고 해당 창작자의 공개를 제한할 수 있습니다. 필터가 권리를 침해한다고 생각하거나 결정에 이의가 있으면 필터 이름, 창작자 이름, 사유를 적어 orangesea2022@gmail.com 으로 보내 주세요.

제9조 (결제 없음)

이 버전에는 판매, 결제, 수익 배분이 없습니다. 쓰인 수는 표시용이며 대가를 청구할 근거가 되지 않습니다.

제10조 (면책과 책임 제한)

앱은 현재 상태로 제공됩니다. 법령이 허용하는 범위에서 운영자는 합리적으로 통제할 수 없는 사유, 이용자가 공개한 필터, 기기에만 있는 데이터의 손실로 생긴 손해에 책임지지 않습니다. 다만 고의 또는 중대한 과실로 인한 책임과 소비자 보호 법령상 포기할 수 없는 권리는 제한하지 않습니다.

제11조 (약관의 변경)

변경 내용은 시행 7일 전(이용자에게 불리한 변경은 30일 전)에 이 주소에 게시합니다. 공개에 영향을 주는 변경은 다음 공개 전에 다시 동의를 받습니다.

제12조 (준거법과 분쟁)

이 약관은 대한민국 법령에 따릅니다. 분쟁은 민사소송법상 관할 법원에서 해결합니다. 소비자는 거주 국가의 강행 법규에 따른 보호를 그대로 받습니다.
